You must be legally permitted to use the Project in your jurisdiction. Users under the age of majority must have the explicit consent and supervision of a legal guardian. By accessing the Project, you represent that all information provided — including license verification — is accurate and truthful.

If you are located in the European Economic Area (EEA), United Kingdom, or California, additional rights and obligations apply to you under GDPR and CCPA respectively. See Section 17 for details.

You are solely responsible for the security of your account. You agree not to share, sell, or transfer your credentials to any third party. Fooshi Mafia is not liable for unauthorized access resulting from a user's failure to secure their own account or local environment. By participating in the Project, you accept these responsibilities in full.

Usage of the Project must be lawful and respectful. The following conduct is strictly prohibited:

• Exploiting software vulnerabilities, glitches, or bypasses.
• Scraping, extracting, or reverse-engineering proprietary data.
• Uploading malicious code, scripts, or unauthorized modifications.
• Harassment, impersonation, or bad-faith interactions with staff or users.

Violations of this section may result in immediate account termination and, where applicable, referral to platform safety teams or law enforcement.

Fooshi Mafia operates strictly on a license-only basis.

• No Ownership: Participation in the Project grants a limited, non-transferable license. It does not constitute ownership of raw assets.
• No Monetary Value: Digital items are strictly for use within the Project and carry no real-world monetary value.
• Community Discretion: We reserve the right to modify or discontinue any feature at our discretion, without liability or prior notice.

We provide technical labor for users who wish to optimize their legally owned assets. This is a peer-to-peer assistance model where the user initiates the request for specific modifications.

• Proof of Purchase (PoP) Requirement: Users must provide verified proof of purchase for the base model before any assistance commences. Requests submitted without valid PoP will not be processed.
• Authorized User Verification: Assistance is offered exclusively to verified license holders. We reserve the right to refuse assistance if asset ownership cannot be validated.
• Labor Fees: All payments are strictly labor fees for technical setup and modification time. These charges do not constitute a resale of original creator assets.

To strictly adhere to third-party use prohibitions and protect intellectual property:

• Private Uploads Only: Modified assets are uploaded exclusively as "Private" to the customer's designated account.
• No Redistribution: Fooshi Mafia does not redistribute, sell, or provide access to raw base model files to any third party under any circumstances.
• User Consistency: Services are tied strictly to the individual account holder who holds the legal license for the base asset. Transfer of delivered assets to any other account or person is a violation of these Terms.

We enforce a zero-tolerance policy regarding asset theft.

• No Extraction: Unauthorized extraction ("ripping"), decompilation, or redistribution of Fooshi Mafia assets is strictly prohibited.
• Private Use Only: Assets are for private use exclusively. Uploading assets as "Public" or "Cloneable" is a direct violation of these Terms.
• Enforcement & Logging: Violations result in an immediate, permanent community ban and a formal DMCA report to platform safety teams (e.g., VRChat Inc.).

Data Protocol Retention Notice: Pursuant to Sections 07 and 09 of our Privacy Policy, Fooshi Mafia reserves the right to retain an irreversible cryptographic hash of the Discord IDs of individuals banned under this section indefinitely to prevent network re-entry. No additional personally identifiable information is retained for this purpose.

Payments are handled via secure third-party providers (e.g., Stripe, PayPal). By completing a purchase, you agree to their respective terms of service. Fooshi Mafia does not store full payment card information and is not liable for processor-side failures, delays, or data incidents.

Refund eligibility is determined as follows:

• Unstarted Work: Eligible for a full refund if no work has commenced. Refund requests must be submitted within 48 hours of payment.
• In-Progress Work: Eligible for a partial refund proportional to the work completed at the time the request is received. The completed portion is non-refundable.
• Delivered Work: Non-refundable once access has been granted or the upload has been completed and confirmed.
• Process: All refund requests must be submitted via a support ticket before any external dispute or chargeback is initiated. Failure to do so may result in automatic forfeiture of refund eligibility (see Section 10).

Fooshi Mafia reserves the right to deny refund requests where evidence of Terms violations is present.

Initiating a chargeback or payment dispute without first contacting support and allowing a reasonable resolution window (72 hours) will result in:

• Immediate and permanent termination of all account access.
• Forfeiture of all digital goods and service licenses associated with the disputed transaction and any other active orders.
• Permanent removal from the Fooshi Mafia project with no right of appeal.

Where chargebacks are determined to be fraudulent or in bad faith, Fooshi Mafia reserves the right to dispute the chargeback with supporting documentation and to report the incident to relevant payment processors and platform safety teams.

The Console and all administrative tools are proprietary systems. Access is a privilege granted exclusively to authorized personnel. Any attempt to spoof, exploit, reverse-engineer, or interfere with internal systems, server webhooks, or community bots will result in an immediate permanent ban and may be referred to law enforcement where applicable.

The Fooshi Mafia name and community branding are unique to this project. We fully respect the intellectual property of the original creator and do not claim ownership of any original assets.

All avatars and modifications provided by Fooshi Mafia are independently created, reconstructed, or customized using legally obtained or client-provided licensed assets. We do not distribute original source files belonging to third-party creators.

Any resemblance to existing designs is either coincidental, client-referenced, or part of an independently recreated and transformative workflow. Fooshi Mafia does not claim ownership of third-party intellectual property used as reference material.

We do not guarantee the Project will be uninterrupted or error-free. We may modify or discontinue any part of the Project at any time without liability or prior notice. Users are encouraged to retain local copies of any delivered assets, as Fooshi Mafia cannot guarantee indefinite storage of uploaded files.

We reserve the right to suspend or terminate access at our discretion if a user violates these Terms or engages in conduct harmful to the integrity of the community. Terminated users forfeit all active service licenses and are not entitled to a refund for work in progress at the time of termination.

• Security Disclaimer: While we take reasonable measures to protect user data, no system is fully secure. We are not liable for unauthorized access outside our direct control.
• Privacy Policy: We collect necessary data (usernames, interaction logs, IP addresses) to operate the Project and prevent fraud. For full details on data collection, retention, and your rights under GDPR and CCPA, see our official Privacy Policy.

Fooshi Mafia is committed to compliance with applicable data protection law. If you are located in the EEA, United Kingdom, or California, the following applies:

• GDPR — EU & UK Residents: You have the right to access, correct, delete, restrict, or port your personal data, and to object to processing based on legitimate interests. To exercise these rights, open a support ticket or email support@fooshimafia.net. We will respond within 30 days as required by law. Our lawful basis for processing is: (a) performance of a contract, (b) legitimate interests (fraud prevention, IP protection), and (c) legal obligation where required.
• CCPA — California Residents: You have the right to know what personal information we collect, request its deletion, and opt out of its sale. We do not sell personal information. You will not be penalized for exercising your privacy rights. CCPA requests will be fulfilled within 45 days as required by law.

If you believe content on our platform infringes your copyright, submit a valid takedown request with proof of ownership to our support channels. Fooshi Mafia maintains internal audit logs of verified authorized usage to respond promptly to such inquiries. Fraudulent or bad-faith takedown requests may be countered under applicable law.

• Limitation: To the maximum extent permitted by applicable law, Fooshi Mafia is not liable for damages, loss of data, or loss of access arising from the use or inability to use the Project.
• Indemnification: You agree to indemnify and hold harmless Fooshi Mafia and its staff from any claims, damages, or liabilities arising from your use of the Project or your violation of these Terms.

Users agree to first attempt informal resolution via Fooshi Mafia support channels before escalating any disagreement externally. As a fan-led project, we are committed to direct, good-faith communication and will make reasonable efforts to resolve issues fairly.

Fooshi Mafia is an independent community and is not affiliated with VRChat Inc. or Discord Inc.

• Dual Compliance: You must also abide by the official VRChat Terms of Service and Discord Terms of Service at all times while using this Project.
• Platform Liability: We are not responsible for account bans, asset breakages, or other consequences resulting from platform updates or disciplinary actions taken by VRChat Inc. or Discord Inc.

Certain community spaces, instances, or assets are restricted based on age in compliance with platform standards and applicable law. We operate two tiers of age-gated access:

• 16+ Content: Access to certain community spaces requires users to be at least 16 years of age. This gate is enforced via Discord's native age-inference metadata.
• 18+ Content: Access to adult-restricted content requires users to be at least 18 years of age and requires successful completion of Discord's native age-verification process. We do not store government IDs or biometric data (see Privacy Policy, Section 02).
• Misrepresentation: Providing false age information, bypassing age gates, or assisting others in circumventing age verification is a serious violation of these Terms. Such conduct will result in immediate permanent removal from the Project and will be reported to relevant platform safety teams.
• Parental / Guardian Responsibility: Where a user under the age of majority has accessed age-restricted content due to a failure of parental supervision, Fooshi Mafia assumes no liability. Legal guardians are responsible for monitoring the online activity of minors in their care.
• Regulatory Compliance: Age verification practices are subject to ongoing review to remain compliant with evolving platform and jurisdictional requirements. Material changes will be announced via Discord.

We may update these Project Guidelines at any time. Material changes will be announced via our Discord community. Continued use of the Project after changes are posted constitutes your acceptance of the updated Terms.
